Will of Littlebury B Ogburn 1858

State of Georgia, Macon County

In the Name of God. Amen.

I, Littlebury Ogburn being of advanced age and knowing that I must depart this life deem it right both as it respects myself and family that I should make a disposition of the property with which a kind providence has blessed me. I do make and ordain this my last will and testament, hereby revolking all others heretofore made by me.

Item 1st
I desire and direct that my body be buried in a decent & Christian like manner suitable to my condition in life. My soul I trust will return unto God who gave it as I hope for salvation through the mercy of Jesus Christ.

Item 2.
I desire & direct that all my just debts be paid by my Executors hereafter named, with as little delay as possible as I am unwilling that my creditors should be delayed in their rights.

Item 3rd.
I desire and direct that all my property of every discription both real & personal & mixed be sold, with the exception of my horse & buggy & one bed, bed stead & furniture, which I give to my beloved wife Nancy Ogburn.

Item 4th.
I desire & direct that the sum of two thousand dollars be retained by my executors in their hands hereafter named, for the use of my beloved wife Nancy Ogburn. Said sum of two thousand dollars to be let out by my executors in good hands and the Interest arising from the said two thousand dollars to be paid over to my said wife annually for her support, and at the death of my said wife I desire and direct that the two thousand dollars thus left in this (illegible) by my executors shall be exactly divided among my lawful heirs share & share alike subject to the restrictions hereafter named. The above provisions for wife I expressly give is clear of division it being my desire that my landed estate be sold free from any encumbrances whatever.

Item 5th.
I desire & direct that all the rest & residue of the money arising from the sale of my estate be equally divided among all my lawful heirs share & share alike subject to the restrictions hereafter named (that is to say) I desire that each of my children living at the time of my death and the legal representatives of such as now or may be dead, receive an equal share of my estate.

Item 6th.
I desire & direct that all the property given by me in this my will to my daughter Edy Blackburn shall go to & become the property of my said daughter & her children, the same not to be subject to the debts of her husband in any manner whatsoever but to belong absolutely to my said daughter & her children, and I do hereby appoint my sons Wm. F. E. Ogburn & Charleton G. Ogburn trustees for my said daughter Edy Blackburn requesting them to accept this trust & carry out the same.

Item 7th.
I hereby appoint my sons William F. E. Ogburn and Charleton G. Ogburn executors to this my last Will & Testament, requesting them to accept the same.

Signed, sealed, declared & published by Littlebury Ogburn as his last Will & Testament in presence of us the subscribing witnesses who subscribed the same in the prescence of said testator at his instance & request and in the presence of each other.
