Will Book 9, Pages 340 & 341
In the name of God amen. I John Ogburn of the County Mecklenburg in the state of Virginia do constitute and make this as my last Will and Testament in manner and form following, Viz.
First Section. I lend to my beloved wife Sarah Ogbourn during her natural life all my land and eight of my slaves which she may choose from all of my slaves.
Second Section. I give to my said wife two negro men Riker and George to her and her Heirs and after the payment of all my Debts I give to my said wife all of my Estate (Land and negroes excepted) of every description to her and her heirs.
Third Section. I give to Eliza Harrison daughter of B. G. Harrison One negro woman slave named Lyddia & her son Charles to her and her Heirs
Fourth Section. All my slaves not herein before disposed of are to be sold upon a credit of Twelve months and the amount of such sale to be divided into four parts. Whereof One part I give to the children of my brother James Ogburn deceased. One part I give to my Brother Charles Ogburn if living otherwise to his children, one part I give to my Brother Benj amin Ogburn if living otherwise to his children and the remaining part I give to my brother Matthew Ogburn if living otherwise to his children.
Fifth Section. After the death of my wife the negroes (together with their increase if any) which I have loaned to my said wife are to be sold upon twelve month credit and the amount of sale divided in the same manner and to the same persons as are named in the Fourth Section.
Sixth Section. After the death of my wife the land I have loaned to her is to be sold upon twelve months credit and the amount of such sale I give equally to my two brothers Charles Ogburn and Matthew Ogburn or to their Heirs.
Seventh Section. I nominate and appoint Daniel Daley and Edwin H. Peete executors to this my last Will and Testament and my desire and will is that my Executors make sale of my negroes and Land wherever the same may be lawfully done according to this Will and for said Executors to make the division of the proceeds of such sales as is herein before divided.
In Testimony whereof I have hereunto set my hand and affixed my seal this 30th day of August in the year One Thousand Eight hundred and Twenty.

Signed sealed and acknow1edged as the last Will and Testament in the presence of Samuel Daley, Crafford McDaniel, Samuel Simmons
At a Court held for Mecklenburg County the 18th day of November, 1822.
The within written last Will and Testament of' John Ogburn dec'd was presented in Court and proved by the oaths of three witnesses thereto suscribed and ordered to be Recorded. And on motion of Daniel Daley one of the Executors therein named who made oath thereto according to Law and together with Samuel Daley & Jno. J. Moore his securities entered into & acknowledged bond in the penalty of Sixty thousand dollars conditioned as the law directs, certificate is granted him for obtaining probate thereof in due form, liberty being reserved to the other Exor. to join in the probate.
Afterwards towit, at the same Court continued & held for the same County the 20th day of November. On motion of Edwin H. Peete another of the exors. therein named who made oath thereto and together with Richard H. Edmonson and Richard Apperson his securities certificate is granted him to join in the probate of said Will.
